Social Security Disability

Our Attorney, Anna-Karina Parker will be an advocate for you in the process of applying for Social Security Disability.  She understands that this is your vital lifeline.  The Social Security Administration provides two programs for disability: SSDI (Social Security Disability Insurance) and SSI (Supplemental Security Income).

SSDI will look at your age and work history, while SSI is an income-based program. You may only qualify for one, but in the process of applying we will look at them both. It is important to note that for SSDI, one must be completely incapable of doing all types of work.

Disability according to Social Security Administration:

“the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment(s) which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.”

In other words, your condition must be so severe that you are unable to do any type of work.

Four Step Process

1. Initial Application: You must first apply for disability at their local office which can be located by Social Security Office at (800) 772-1213 or at their website www.socialsecurity.gov.

Remember 70% or more are denied at this stage, so if you receive a denial letter do not be discouraged and call our offices.

2. Reconsideration: After receiving your initial denial, it is time to file for reconsideration where an independent person will review your file.

Again if you receie a denial do not be discouraged, but knonow that 80% are denied at this stage.

3. Administrative Hearing: This is your chance to present your case personally before a judge. Where all the medical records are now placed with a real person and face. Although representation is not required, it is beneficial to have a representative prepare and organize your case to your advantage.

4. Appeals Council Review: This is a seperate council that will review all evidence and if there is additional evidence, it may be submitted to the council.
